Weil Twitter zwei seiner Tweets einem Faktencheck unterzogen hat, will US-Präsident Donald Trump zurückschlagen und Online-Diensten ihre Haftungsfreiheit wegnehmen. Doch in der Debatte geht es nur am Rande um juristische Details.

Mit einer Durchführungsverordnung will US-Präsident Donald Trump dafür sorgen, ungehindert in sozialen Netzwerken hetzen und lügen zu können. Ein Entwurf der Verordnung ist inzwischen durchgesickert, die offizielle Präsentation wird heute im Laufe des Tages erwartet.

Anlass für die Ankündigung ist die jüngste Entscheidung Twitters, zwei Tweets des US-Präsidenten erstmals mit einem Faktencheck zu versehen. Trump hatte fälschlicherweise und zum wiederholten Male behauptet, Briefwahlen seien ein Einfallstor für Wahlmanipulation. Twitter begründete das außergewöhnliche Vorgehen mit der möglichen Verunsicherung von Wählern, der Rest des vor Lügen strotzenden Feeds von Trump blieb unangetastet.

In seiner Verfügung will der US-Präsident Regulierungsbehörden anweisen, die Haftungsfreiheit von Online-Plattformen zu überprüfen und die Regeln gegebenenfalls anzupassen. Konkret geht es um einen Abschnitt im „Communications Decency Act“ (CDA), der in den USA das sogenannte Providerprivileg festschreibt

Dieses befreit Online-Dienste von einer unmittelbaren Haftung für Inhalte, die Nutzer auf einer Plattform hinterlassen. Zudem stellt die „Section 230“ des CDA klar, dass die Betreiber solcher Plattformen Inhalte, etwa anstößiges oder hasserfülltes Material, moderieren können wie es ihnen beliebt.

Rechte Trolle im Weißen Haus

Um diesen Abschnitt tobt schon seit geraumer Zeit eine heftige Debatte. Rechtskonservative Politiker wie Josh Hawley behaupten, die aus dem „liberalen“ Silicon Valley stammenden Diensteanbieter wie Twitter und Facebook würden die Haftungsfreiheit dazu nutzen, um konservative Stimmen im Internet zum Verstummen zu bringen. Im vergangenen Sommer veranstaltete das Weiße Haus sogar eine bizarre Veranstaltung mit rechtsradikalen Trollen wie Charlie Kirk oder „Carpe Donktum“, die sich unterdrückt fühlen.

Obwohl an den Vorwürfen wenig dran ist, handelt es sich um eine effektive Taktik, US-Plattformen davon abzubringen, gegen hetzende Rechte vorzugehen. So sträubt sich etwa Twitter dagegen, Neo-Nazis gleich zu behandeln wie Verbreiter von ISIS-Propaganda. Zu Recht fürchtet das Unternehmen, dass dabei Accounts von prominenten Republikanern unter die Räder kommen würden, die ungestraft mit Lügen und Hass die US-Öffentlichkeit manipulieren.

Ähnlich bei Facebook: Zuletzt berichtete das Wall Street Journal, der Konzern habe eine interne Studie unter den Teppich gekehrt, die den firmeneigenen Algorithmen eine radikalisierende Rolle zuschreibt. Auch hier wären bei einer Änderung insbesondere konservative Nutzer betroffen gewesen, fürchtete Facebooks Policy-Chef, der rechts-konservative Joel Kaplan.

Washington fest in rechter Hand

Facebook und seinem Chef, Mark Zuckerberg, liegt viel daran, es sich mit der rechten Mehrheit in der US-Politik nicht zu verscherzen – die selbstverständlich nicht „unterdrückt“ wird, sondern derzeit nahezu alle Machthebel der USA in der Hand hält. Diese könnte sie etwa dafür einsetzen, dem Unternehmen wirtschaftlich zu schaden. Ein Albtraum für das Unternehmen, den es mit allen Mitteln abzuwenden gilt.

So besteht inzwischen das Lobbyisten-Team in Washington fast ausschließlich aus langjährigen konservativen Aktivisten, die Rechts-außen-Publikation Daily Caller spielte Faktenchecker für die Plattform, und Zuckerberg lädt regelmäßig prominente Rechte wie Ben Shapiro oder Byron York zu sich nach Hause ein – um dem Vorwurf aus dem Weg zu gehen, allzu „liberal“ zu sein.

Es ist auch Zuckerberg selbst, der nun die Gunst der Stunde nutzt, die aktuelle Auseinandersetzung zu seinem und Facebooks Vorteil zu wenden. In einem gestrigen Interview mit dem rechten TV-Sender Fox News sagte Zuckerberg, er sehe die Rolle von Facebook nicht als Entscheidungsinstanz darüber, wer im Internet die Wahrheit sagt und wer lügt.

„Private Unternehmen, vor allem diese Plattform-Unternehmen“, sagte Zuckerberg, „sollten vermutlich nicht in dieser Position sein, solche Entscheidungen zu treffen“. Zuletzt hatte der Konzern ein Gremium ins Leben gerufen, um die Klärung dieser Fragen an unabhängige Experten auszulagern.

Was die juristische Substanz der erwarteten Trumpschen Verordnung betrifft, dürfte es sich vorrangig um Theaterdonner handeln. Schon allein deshalb, weil es die US-Verfassung praktisch unmöglich macht, das Recht privater Unternehmen auf freie Meinungsäußerung einzuschränken – wozu auch willkürliche Inhaltemoderation zählt. Die Stanford-Forscherin Daphne Keller veröffentlichte eine kommentierte Bewertung des Entwurfs. Ihrer Einschätzung zufolge ist der Text überwiegend „atmosphärisch“ und „juristisch fragwürdig“.

Und der UN-Sonderberichterstatter für Meinungsfreiheit, David Kaye, warnte davor, den Wald vor lauter Bäumen nicht zu übersehen. „Trump will einfach nur Twitter einschüchtern, um keinen Faktenchecks unterworfen zu werden“, schrieb Kaye auf Twitter. „Der Rest sind Nebelkerzen“. Die aber nichtsdestotrotz den Rahmen abstecken könnten, unter welchen Bedingungen die anstehende Präsidentschaftswahl stattfinden wird.

so ganz von de Hand zu weisen ist das nicht was der Zuckerberg da sagt. Ist es wirklich eine gute Idee Angestellte eines privaten, profitorientierten Unternehmens entscheiden zu lassen was die Wahrheit ist und was nicht? Was veröffentlicht werden darf und was nicht?

Mit einer für mich erstaunlichen Selbstverständlichkeit gehen viele davon aus, das dann nur noch das bei Facebook und auf Twitter gepostet wird, was sie für die Wahrheit halten. Aber mal ehrlich. Wie sicher ist das?

Unilever stellt eine Margarine her. Mit dem Wissenschaftler Professor Dr. Hans-Ulrich Klör machen sie Werbung für das Zeug. Klör wird zitiert, aus wissenschaftlicher Sicht gebe es keinen Hinweis, dass der Verzehr von Produkten, die mit Pflanzensterinen angereichert sind, zu Nebenwirkungen führen könnte. Foodwatch behauptet das es sehr wohl Hinweise gibt das die Margarine schädlich sei. Unilever sagt das genaue Gegenteil. Ganz offensichtlich sagt einer die Unwahrheit.

Was nun? Wessen Beiträge soll Facebook löschen? Sollen sie sich wie ein amerikanisches Gericht verhalten und eigene Ermittlungen anstellen, Studien lesen, Gutachten beauftragen und dann zu einer Entscheidung kommen? Und das immer, wenn zu einer Sache zwei unterschiedliche Behauptungen aufgestellt werden?

Und dann fällt das Facebook nachgeordnete Gericht ein Urteil. Was, wenn es anders ausfällt als das von Facebook? Die gelöschten Postings wiederherstellen und dafür die anderen löschen?

Bleiben wir mal bei dem Beispiel. Hier gibt es mit Sicherheit einen Haufen Leute, die in diesem Streit auf der Seite von Foodwatch gestanden hätten. Nun hat aber Unilever den Streit vor mehreren Instanzen gewonnen. Bei Herrn Klörs Aussage handelt es sich um eine Meinungsäusserung und keine Tatsachenbehauptung. Und nun? Was erwarten wir nun von facebook?

Wo ist dann der Unterschied zwischen Lüge und Irrtum? Das RKI hat einige der Aussagen vom Beginn der Coronapandemie auf Grund neuer Erkenntnisse revidieren müssen. An sich ein ganz normaler Vorgang. Aber was soll Facebook nun machen? Alle Postings des RKI nachträglich mit einem Hinweis versehen? Dazu noch all die, die das zitiert oder geteilt haben? Also alle bisherigen Postings (ob zu Corona oder zu einem anderen Thema) täglich neu bewerten und mit entsprechenden Hinweisen versehen?

Ich bleibe dabei. Wenn, was ich bezweifle, es eine Instanz geben kann die in den sozialen Medien nach wahr und unwahr bewertet und sortiert, dann können das auf keinen Fall private Unternehmen sein.

Kurz gesagt. Warum soll das Facebook machen und nicht Foxnews?

Mal davon abgesehen. Man hört allenthalben Klagen, wie mächtig doch die Betreiber der sozial Media Plattformen geworden sind. Und Minuten später taucht die Forderung auf, eben jene Betreiber sollen doch bitte ihre Möglichkeiten ausnutzen um zu steuern, was auf diesen Plattformen gesagt wird.

SAN FRANCISCO — Earlier this week, as Twitter executives waded into a confrontation with President Trump, Mark Zuckerberg, chief executive of Facebook, took a very different tack: He kept his head down.

The company said the president violated rules regarding voter suppression. Mr. Trump posted the same words on Facebook, which has similar rules around voter suppression. Twitter’s face-off escalated Friday morning, when the company attached an addendum to one of [ Link nur für registrierte Mitglieder sichtbar. Bitte einloggen oder neu registrieren ]. Jack Dorsey, chief executive of Twitter, took to his site not long after to say Twitter would not back down, presenting a stark contrast to Mr. Zuckerberg, who, in an interview a day earlier with Fox News, said Facebook wasn’t going to judge Mr. Trump’s posts.

“We’ve been pretty clear on our policy that we think that it wouldn’t be right for us to do fact checks for politicians,” Mr. Zuckerberg said. “I think in general, private companies probably shouldn’t be — or especially these platform companies — shouldn’t be in the position of doing that.”

Mr. Zuckerberg’s reminder that Facebook would not interfere with posts from Mr. Trump — even if they violate rules that would apply to other people — was in part the product of his longtime belief that his company should avoid getting into the political fray and let its three billion users have their say.


President Trump’s tweet on voting practices received a fact check from Twitter.


The same post by President Trump on Facebook received no alterations despite Facebook having very similar rules around voter suppression.

His assurance that his company would not be an “arbiter of truth” in political discussion was also indicative of an aggressive effort over the last year or so to court Republicans in Washington and conservative voices in the media. The goal: to keep regulators off his giant internet company’s back.

By staying on the sidelines as Twitter does battle with Mr. Trump and his allies, Mr. Zuckerberg could gain unlikely Republican friends to stave off regulatory intervention into his business, which lawmakers around the world [ Link nur für registrierte Mitglieder sichtbar. Many people in the tech industry believe regulators — not economic collapse brought on by the coronavirus pandemic or any other problem — are the one existential risk to Mr. Zuckerberg’s business.

“Zuckerberg’s instincts have been right,” said Brendan Carr, a Republican commissioner at the Federal Communications Commission. “Zuckerberg said, ‘We trust people to make up their minds.’”

But Mr. Zuckerberg’s hands-off approach to Mr. Trump’s increasingly incendiary behavior on social media runs the risk of alienating some users who think the rules about what can be posted to Facebook should be applied equally to everyone, including world leaders. It could also infuriate some of the company’s Silicon Valley work force, who still believe Facebook isn’t doing enough to counter misinformation campaigns.

And it could lend more ammunition to critics who say Mr. Zuckerberg is still unwilling — or unable — to own up to his company’s role in disseminating information to the world, particularly when many news organizations are collapsing.

“Twitter and Facebook both have community standards and policies to combat voter suppression, hate and the incitement of violence, and yet Twitter is actually enforcing those standards against the president of the United States and Facebook is doing nothing,” said Vanita Gupta, the president of the Leadership Conference of Civil and Human Rights. “The harm from this approach by Facebook is mass confusion, voter suppression and possible violence.”

Twitter has started to experience the repercussions of taking on the White House. Several Republican lawmakers and regulators argued — on Twitter — that Twitter was being hypocritical because it was focusing on Mr. Trump while allowing other world leaders to spread lies.

“I’m filing a complaint with the Federal Election Commission because of Twitter’s domestic election interference against President @realDonaldTrump,” Representative Matt Gaetz of Florida said in a tweet.



After Twitter applied the warning label on a tweet from Mr. Trump on Friday morning, Ajit Pai, the F.C.C. chairman, called on Twitter to apply its rules against inciting violence equally to other world leaders. “Twitter is doubling down and they are showing how amazingly bad they are at the politics on this,” said Rachel Bovard, a senior adviser to the conservative Internet Accountability Project and a former aide to Republican senators Mike Lee of Utah and Rand Paul of Kentucky. “Republicans want social media to be a pass-through, a billboard. They believe bad speech will be countered by good speech and that is what Zuckerberg is saying he will do.”

Facebook did not immediately comment on Friday. A spokesman for Twitter declined to comment.

In truth, Facebook’s and Twitter’s rules are not all that different. Both companies have said they would take down posts, even from a president, if they contained threats and incitement to violence or attempts to suppress voter turnout or citizens’ ability to [ Link nur für registrierte Mitglieder sichtbar. But when it comes to political discussion and advertising, the companies have diverged over the last year.

Mr. Zuckerberg’s courtship of conservatives has been aided by Joel Kaplan, a former aide in President George W. Bush’s administration and a well-connected Washington operative. Mr. Zuckerberg and Mr. Kaplan have tried to convince Republicans that although Silicon Valley may be largely left-leaning, Facebook’s platform itself is neutral.

Courting conservatives seems to have helped Facebook in Washington, but the strategy has not been entirely embraced by the company’s employees.

Some have long believed that a double standard applies to conservatives on the platform. In discussions posted to the company’s internal message boards and privately between employees on Friday, workers wondered what the final breaking point will be for Facebook to enforce its rules evenly, according to three people familiar with the company’s internal deliberations.

Mr. Zuckerberg’s attempts to avoid the political fray face additional challenges. Democrats are criticizing Mr. Zuckerberg’s unwillingness to enforce its policies, while Republicans are embracing an executive order handed down by President Trump that could make tech companies — including, and especially, Facebook — [ Link nur für registrierte Mitglieder sichtbar. Despite what he called his own “visceral negative reaction” to Mr. Trump’s language, Mr. Zuckerberg said he felt compelled to keep the posts up on Facebook and Instagram, and that the president’s language did not violate the company’s policies.

“I know many people are upset that we’ve left the President’s posts up, but our position is that we should enable as much expression as possible unless it will cause imminent risk of specific harms or dangers spelled out in clear policies,” Mr. Zuckerberg wrote.

“ I disagree strongly with how the President spoke about this,” he continued, “but I believe people should be able to see this for themselves, because ultimately accountability for those in positions of power can only happen when their speech is scrutinized out in the open.”

Facebook’s decision not to take action against recent posts about mail-in ballots and the Minnesota protests by President Trump is roiling employees, some of whom are calling on executives to reconsider their stance. In response to an internal post explaining the company’s rationale, some employees criticized the company’s neutral posture.

“I have to say I am finding the contortions we have to go through incredibly hard to stomach,” one employee wrote in a comment about the shooting post. “All this points to a very high risk of a violent escalation and civil unrest in November and if we fail the test case here, history will not judge us kindly.”

On Tuesday Twitter labeled two tweets about mail-in voting as “potentially misleading” for suggesting the practice would lead to a rigged election. Early Friday morning, Twitter placed another tweet behind an interstitial warning for “glorifying violence” because it included the sentence “when the looting starts, the shooting starts.” In all cases, the tweets were cross-posted to Facebook.

In between those events, Monika Bickert, the company’s vice president of global policy management, wrote a lengthy post on Workplace, the company’s internal version of Facebook, laying out the company’s rationale for not taking action on the mail-in ballot post.

“We reviewed the claim and determined that it doesn’t break our rules against voter interference because it doesn’t mislead people about how they can register to vote or the different ways they can vote,” Bickert wrote Thursday in a post that received more than 700 comments. “If it had, we should have removed the post from our platform altogether because our voter interference policy applies to everyone, including politicians.”

She continued: “That said, we do not believe that a private technology company like Facebook should be in the business of vetting what politicians say in the context of a political debate. As is the case with the President’s tweets, speech from candidates and elected officials is highly scrutinized and debated. We think people should be allowed to hear what politicians say, make up their own minds and hold politicians to account.”

But then Trump cross-posted to Facebook a tweet that seemed to suggest that violent action be taken against people protesting the death of George Floyd at the hands of Minnesota police. “Would it be possible to explain in more detail the interpretation of our community standards?” one employee asked. “Does this post violate them but get an exemption, or is it not violating?”

But by mid-afternoon Pacific time on Friday, employees had not received a response — and they were beginning to grow frustrated. “It’s egregious that nobody from policy has chimed in or provided any sort of context here,” one employee said. When another employee defended Facebook’s silence by suggesting that top executives were likely debating their next steps, the original poster replied: “They’ve already made an official decision by keeping the post up after it’s been reported. They should communicate their justification for the decision.”

Another employee suggested that no one had responded to them “because Facebook’s community of employees has demonstrated many times that private deliberations will be leaked to the press and taken out of context.”

“I don’t think employees are asking anything here that the public doesn’t deserve to know,” a colleague responded. But another post viewed by The Verge suggests that an initial review of Trump’s “shooting” post “was deemed to be non-violating.”

“Makes me sad and frankly ashamed,” one employee wrote in response. “Hopefully this wasn’t the final assessment? Hopefully there is still someone somewhere discussing how and why this is clearly advocating for violence?”

Wrote another: “It’s been said previously that inciting violence would cause a post to be removed. I too would like to know why the goals shifted, and where they are now.”

Another employee compared working at Facebook to a comedy sketch by the duo Mitchell and Webb in which two SS officers are talking during World War II and one asks the other, “Are we the baddies?” “Waking up every morning at FB now and having this run through my head, immediately followed by ‘yes, apparently,’” the employee wrote, above a GIF of the sketch.

“It’s honestly really hard for me to take seriously the words of support from our leadership this morning if we allow content like this on our platform,” someone wrote underneath the Mitchell and Webb post. “Whatever we are getting from not acting on this, is it worth allowing clear, violent threats against Black protesters?”

Facebook had no immediate comment.
